66% of the country feel it is disrespectful to burn an American flag in protest. Yet, it is protected under the 1st amendment as Dj stated above. The Supreme Court has been very clear regarding this debate.

A flag can be burned under certain conditions in a dignified manner.

Don't know about now, but back in the day, burning was the appropriate way to decommission a tattered and damaged flag. BUT, there was a ceremony/ritual that had to take place first. Just burning a flag was illegal.
 
Basically what he wants is prosecution on disturbing the peace, lighting a fire in a public place, or incitement. His DOJ could already do this.

I believe that the guy who.lit the flag got off because a grand jury wouldn't indight
